PROPERTY LISTING AND TECHNICAL BROKERAGE AGREEMENT
Preamble:
This Agreement constitutes a legally binding contract between "Iqamaty Al-Saeeda for Reservation Services", the lawful owner and operator of the Iqamaty Platform, hereinafter referred to as the "(First Party / The Platform)", and the service provider, owner, or legally authorized representative of the property, hereinafter referred to as the "(Second Party / The Host)". This Agreement consists of (12) core legal clauses that constitute a single, indivisible contract. The Second Party’s acceptance (whether electronically or in writing) constitutes an express acknowledgment and final legal commitment to all the following clauses:
Clause 1: Ownership and Legal Account Verification
The Second Party (The Host) warrants and represents that they are the lawful owner of the listed property or hold an official, legally binding authorization allowing them to manage and rent it. For account activation, the Second Party commits to uploading clear and valid documentation through the platform, including: (Personal ID or Passport) along with (The Title Deed / Al-Qushan). If the applicant is not the owner, an (Officially Approved Authorization Letter) is strictly required. The signing entity assumes exclusive legal and judicial liability for the authenticity and validity of these documents.
Clause 2: Pricing Mechanism and Operational Service Fees
The Second Party shall determine the "Net Amount" they wish to receive for renting their property, and the Platform’s commission charged to the Host shall be exactly (0%). In return, the Second Party explicitly acknowledges and agrees that Iqamaty Platform retains the absolute and unilateral right to add operational, technical, and assurance service fees ranging between (13% to 15%) on top of the Host's net price. These fees shall be seamlessly incorporated into the "Total Combined Price" displayed to guests on the search page to ensure pricing stability and streamline the online checkout process.
Clause 3: Free Marketing and Support for the Host
The First Party (Iqamaty Platform) legally commits to providing extensive, free marketing and promotional services for the Second Party's listings through paid advertising campaigns and social media channels to increase occupancy rates and maximize the Host's revenues. Furthermore, the Platform provides an advanced reservation management system free of charge, alongside 24/7 technical support to resolve any technical issues facing the Host.
Clause 4: Property Habitability and Listing Accuracy
The Second Party strictly commits to ensuring that the property is completely ready, fully functional, and cleaned in accordance with the highest health, hygiene, and hospitality standards (specifically regarding bedding, towels, and sanitary facilities) at the scheduled check-in time. The property must be 100% identical to the photos, data, and amenities published by the Host on the platform.
Clause 5: Travel Issues and Arrival Defects
In the event of Guest arrival where a material structural defect or misrepresentation is verified against the property (such as a total lack of basic cleanliness, non-matching photos, or failure of major advertised amenities including the swimming pool, air conditioning, heating, water, or electricity), or if the Host fails to provide physical access to the property; Iqamaty Platform retains the absolute right to immediately cancel the reservation, issue a full refund to the Guest, hold the Second Party fully legally and financially liable.
Clause 6: Protection of Host Rights Against Guest Damage
Iqamaty Platform commits to protecting the Host by maintaining a secure booking environment. Under the Platform’s general terms of service for guests, renters are held fully legally and financially liable for preserving the property and its contents and compensating for any damages caused during their stay. In the event of documented damage, the Platform will utilize its technical and commercial efforts to assist the Host in recovering fair compensation from the guest and providing official registration data to facilitate necessary legal actions.
Clause 7: Calendar Maintenance and Cancellation Compliance
Calendar Updates: The Second Party assumes exclusive responsibility for updating the "Availability Calendar" of their property on the application on a continuous basis. In the event of accepting a double booking, the Host is legally obligated to provide alternative accommodation of a similar or higher standard at their own expense or bear the administrative financial penalties determined by the Platform.
Cancellation Policies: The Second Party explicitly agrees to comply with the cancellation policy (Flexible, Moderate, or Strict) that they selected for their property upon listing, and accepts its algorithmic and financial application upon reservation cancellation by either party.
Clause 8: Booking Options
Booking Mechanism Options: Upon listing the property on the Platform, the Second Party holds the absolute right to choose between two booking mechanisms:
(First: Instant Book), which allows guests to book and pay for the property immediately without prior approval.
(Second: Request to Book), which allows the Host to review the guest's profile and either accept or decline the request within a designated technical timeframe. The payment and verification process via HyperPay will only proceed after the Host's explicit and clear approval of the request.
Clause 9: Anti-Circumvention and Payment Exclusivity
Members and Hosts are strictly prohibited from requesting, making, or accepting bookings or monetary transfers outside of the Iqamaty Platform's software framework to evade service fees or commissions. Any attempts to exchange contact details or arrange offline payments will result in immediate listing deletion and permanent account suspension, while the Platform retains its full legal right to claim any bypassed commissions and damages.
Clause 10: Limitation of Liability (On-Site Check-in and Contracts)
The Second Party acknowledges that Iqamaty Platform acts strictly as an intermediary technology venue and software interface. Therefore, the Platform assumes zero liability regarding the drafting or writing of the direct lease contract between the Owner and the Renter. Furthermore, the Platform is entirely absolved from any responsibility regarding on-site check-in workflows or public safety verification. The Second Party maintains exclusive liability for logging and collecting guests' official identification documents (such as passports or IDs) and complying with all local administrative and security regulations in the country where the property is located.
Clause 11: Platform Payout Commitment and Settlement
Iqamaty Platform legally commits to transferring and processing the Net Rental Amount due to the Host immediately following the Guest's successful check-in (within 24 to 48 hours from the actual check-in date) to ensure reservation integrity and property compliance. Payouts shall be processed via the instant payment system (CliQ), local bank transfer, or according to the Host's approved and pre-configured payout preference in their account profile.
Clause 12: Governing Law and Jurisdiction
This Agreement shall be governed by and construed under the applicable laws. The Courts of Amman (Palace of Justice) or the competent judicial courts in the country where the property is located shall hold exclusive jurisdiction over any legal claims or disputes arising from the execution or interpretation of this contract.
Execution and Acknowledgments:
For Electronic Acceptance: Activating the checkbox [I agree to the Property Listing and Technical Brokerage Agreement] during registration constitutes an official, legally binding, and valid electronic signature, fully enforceable before all judicial authorities.
