Iqamaty Platform Terms & Conditions
These Terms of Service and their incorporated policies ("Terms") are a binding legal agreement between you and Iqamaty Al-Saeeda for reservation services (referred to herein as "Iqamaty", "we", "us", or "our") being the legal owner and operator of the websites, applications, and technical services (collectively referred to as the "Iqamaty Platform or Iqamaty.com").
The Iqamaty Platform provides an online, interactive, peer-to-peer marketplace that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests, Participants, or Travelers.”
Iqamaty acts strictly as an online technology marketplace and advertising venue. It is not a party to any rental contracts entered into directly between Hosts and Guests. Iqamaty is not a real estate broker, travel agency, tour operator, or insurance company, and does not act as an agent for any member in any capacity, except to facilitate commission and payment collections as outlined herein.
Introduction and Agreement Structure
This Contract and its incorporated policies consist of (19) core, interconnected legal clauses that constitute a single, indivisible agreement.
For clarity and compliance, this document is structured into main sections:
Chapter 1: General Terms for Guests
Governing search mechanisms, deposit payments, accommodation licenses, and renter responsibilities.
Chapter 2: General Terms for Hosts
Governing listing management, local and security licensing, and owner's legal obligations.
Chapter 3 & 4: Reservation Cancellation and Refund Policies
Governing cancellation rules and rebooking/refund remedies.
Chapter 5: General Terms, Operational Workflows, and Disclaimers
Including the Partial Deposit Model (Al-Arboon), Anti-Circumvention rules, Disclaimer of liability, and Governing Law.
CHAPTER 1: GENERAL TERMS FOR GUESTS (Guest Terms)
1. Search, Booking, and Financial Obligations
1.1 Browsing Listings:
Guests can browse listings and view descriptions, photos, pricing, and reviews available on the platform.
1.2 Total Price and Charges:
When requesting a booking, the Guest agrees to pay all charges specified at checkout, which include the property rental price, Iqamaty service fees, applicable taxes, and insurance, if any.
1.3 Direct Contractual Framework:
A binding legal contract is created directly between the Guest and the Host upon confirmation of the reservation. The Guest is responsible for complying with all booking conditions, house rules, and cancellation policy chosen by the Owner.
2. Accommodation License and Eviction Rules
A confirmed booking constitutes a temporary, limited license granted to the Guest to enter, occupy, and use the property for the duration of the booked stay only.
The Guest agrees to vacate the property immediately upon expiration of the specified check-out time. Unauthorized overstaying may result in lawful eviction measures and additional penalties.
3. Guest Responsibilities and Assumption of Risk
3.1 Liability for Damage:
Guests are responsible for their own acts and omissions and the acts of any individuals, visitors, or pets they invite into the property.
Guests must maintain the property and its contents and assume full financial and legal liability for any damage caused during their stay.
3.2 Inherent Risks Acceptance:
Guests acknowledge that travel activities such as farms, swimming pools, or recreational amenities may carry physical risks. The Guest assumes all risks arising from their stay and use of facilities.
CHAPTER 2: GENERAL TERMS FOR HOSTS (Host Terms)
4. Hosting and Listings
Iqamaty grants Owners the right to use the platform to list properties with our community to generate income.
It is the Owner's sole responsibility to provide complete, accurate, and updated information regarding the property, pricing, and house rules, and to keep calendar availability updated at all times to prevent double-bookings.
5. Independence of Hosts
Your relationship with Iqamaty is that of an independent individual or entity utilizing technological services, and is not an employee, agent, legal partner, or joint venture of Iqamaty.
The platform does not direct, manage, or control your property or how you provide hosting services, and Owners maintain absolute discretion in managing their properties.
6. Compliance, Licensing, and Security Regulations (GCC & Global)
6.1 Local Regulations:
The Owner is solely and independently responsible for understanding and complying with all local laws, rules, tax obligations, and short-term and long-term rental regulations applicable to their property.
6.2 Mandatory Licensing:
The Owner represents and warrants that they hold all valid governmental licenses, tourism permits, or real estate documents required by local authorities to offer short-term and long-term vacation rentals.
Iqamaty acts strictly as a technology venue and is not liable for any fines or legal closures resulting from unlicensed properties. The Owner assumes exclusive criminal, financial, and administrative liability before local authorities.
6.3 Security Systems:
Owners must comply with local security systems and regulations regarding Guest data logging and public safety reporting.
CHAPTER 3: RESERVATION CANCELLATION POLICIES
Owners must select one of the following three cancellation policies for each listed property, which will strictly and algorithmically apply to the Guest upon cancellation.
7. FLEXIBLE Policy
Cancellation 48 hours or more before arrival:
The Guest will receive a full refund of the property rental amount, except Iqamaty service fees and platform transaction charges, which are strictly non-refundable and will be deducted.
Cancellation less than 48 hours before arrival / No-Show:
If the Guest cancels less than 48 hours before the scheduled check-in time, or fails to show up, the Total Price will be fully charged. The Guest shall receive no refund.
8. MODERATE Policy
Cancellation 5 days or more prior to arrival:
The Guest will receive a full refund of the property rental amount, excluding Iqamaty service fees and transaction charges.
Cancellation less than 5 days prior to arrival / No-Show:
If the Guest cancels less than 5 days before the scheduled check-in time, or fails to show up, the Total Price of the reservation will be fully charged, and no refund will be issued.
9. STRICT Policy
Strictly Non-Refundable:
Once the reservation is confirmed and paid, it is completely non-refundable. If the Guest cancels at any time after confirmation, the Total Price will be charged in full.
CHAPTER 4: REBOOKING AND REFUND POLICY FOR GUEST DISRUPTIONS
10. Host Cancellations Prior to Check-In
If an Owner cancels a confirmed reservation before the scheduled check-in, the Guest will automatically receive a full refund of all amounts paid to the platform.
Iqamaty will utilize its reasonable commercial efforts to assist the Guest in finding available alternative accommodations of a similar standard on the website.
11. Covered Travel Issues and Arrival Defects
The Guest must submit a formal dispute via the technical support page within a maximum of 72 hours of discovering the issue, backed by clear evidence such as photos or videos.
The platform will intervene to issue a full or partial refund to the Guest strictly in the following cases:
- The Owner fails to provide access to the property (wrong keys, non-responsive Host).
- The Owner fails to disclose that a co-host, another person, or a pet will be sharing the property with the Guest.
- The property is not habitable upon check-in due to: lack of basic cleanliness, severe structural or safety hazards, active pest infestations, incorrect property type received, material discrepancy in bedroom count or location, or complete failure of major advertised amenities.
12. Financial Penalties on Defaulting Hosts
If a Host cancels a stay without a valid force majeure event, or if a valid structural defect is verified against them, Iqamaty reserves the right to freeze their payout, forfeit earnings for that reservation, and deduct refund amounts from current or future platform payouts.
CHAPTER 5: GENERAL TERMS, OPERATIONAL WORKFLOWS, AND DISCLAIMERS
13. The Partial Deposit Model ("Al-Arboon")
To streamline international financial workflows, Iqamaty reserves the right to apply a partial deposit model.
The Guest pays a specified partial fee online via the platform representing Iqamaty's booking commission to secure the reservation, while the remaining rental balance is settled directly with the Owner in cash or via local bank transfer upon physical arrival and key collection.
Iqamaty assumes zero legal or commercial liability for any collection disputes, defaults, or non-payments regarding the remaining balance on-site. Such disputes remain exclusively between the Owner and the Renter.
14. Anti-Circumvention Policy
Members are strictly prohibited from requesting, making, or accepting bookings or monetary transfers outside of the platform to evade service fees or commissions.
Any attempts to exchange contact details or arrange offline payments will result in immediate listing deletion and permanent account suspension.
Iqamaty retains its full legal right to claim any bypassed platform commissions.
15. Absolute Disclaimer and Limitation of Liability
IQAMATY, ITS OFFICERS, AFFILIATES, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY CIVIL, CRIMINAL, OR COMPENSATORY DAMAGES, INCLUDING PROPERTY DAMAGE, THEFT, PHYSICAL ALTERCATIONS, SECURITY INCIDENTS, FIRES, NATURAL DISASTERS, DROWNING ACCIDENTS IN SWIMMING POOLS, PERSONAL INJURIES, OR DEATH OCCURRING WITHIN OR IN CONNECTION WITH ANY PROPERTY LISTED ON THE PLATFORM.
The rental, security, and safety compliance remain exclusively the direct personal civil responsibility of the Owner and the Guest. The platform's role is strictly limited to providing the intermediary software interface.
16. Right to Amend and Modify Terms Clause
Iqamaty Platform (Iqamaty Al-Saeeda for Booking Services) reserves the absolute and unilateral right to amend, modify, update, add, or delete any clauses of this Agreement and its incorporated policies at any time.
These modifications may be made to align with business requirements, technical updates of the website/application, or regulatory and tax changes, without the need to obtain prior consent from users.
The user's continued access or use of the platform following any modifications constitutes express, final, and legally binding acceptance of all updated terms.
17. Platform Wallet Balance (Travel Credit)
Iqamaty reserves the right, at its sole operational discretion, to issue verified user refunds in the form of internal Platform Travel Credit (Wallet Balance) added to the user's account for future booking usage, instead of cash-back reversals.
18. Governing Law and Choice of Jurisdiction
18.1 For Domestic Jordan Operations:
Governed by and construed under the laws of Jordan, and the Courts of Amman (Palace of Justice) hold exclusive jurisdiction over judicial claims.
18.2 For International and GCC Operations:
For listings or users located outside Jordan, Iqamaty retains the right to initiate legal actions or resolve disputes either before the Courts of Amman or before the competent judicial courts of the country where the property is located or where the user resides, under applicable local laws.
Users waive their right to sue Iqamaty outside Jordan without express written management consent.
